One of the most disturbing testimonies about Hamas's war crimes on October 7th was recently revealed by Southern District Attorney, Adv. Moran Gez, who leads the legal investigation of the massacre events. As part of her role as a member of the "Team 7.10" and being responsible for security and sexual offense cases, Gez reveals a chilling picture of crimes against humanity.

"Hamas terrorists raped women and murdered them during the rape". Gez states definitively. "The only punishment for them – death". The senior prosecutor's words clarify the severity of the acts and the need for an appropriate legal response.

Hamas's war crimes include a wide range of sexual offenses – from sexual humiliation and indecent acts to brutal rapes ending in murder. The organization's planned attack included not only mass murder but also a deliberate strategy of humiliation and sexual assault.

The Israeli legal system now faces an unprecedented challenge. "Liberal and enlightened Israeli law treats all offenders equally", Gez explains, "therefore legislative changes and adaptation of Israeli law are needed to address the atrocities that occurred that day".

The absence of formal complaints does not indicate an absence of crimes. Gez clarifies that the reasons are tragic: "The Hamas terrorists who raped the Israeli young women murdered them, even during the rape". Additionally, women who were raped and survived the attack struggle to find the courage to file complaints due to deep trauma.

Attempts by pro-Palestinian organizations to distort her words and deny the sexual violence crimes are met with a firm response from her. "Any other interpretation of my words is nothing more than cheap propaganda and ignores the fact that Hamas terrorists committed war crimes", she emphasizes.

In the case of released hostages who testified about the horrors they experienced in captivity, the legal situation is clearer. "It will be legally simpler to prosecute and prove what was done to their bodies and souls", notes Gez.

The legal system must now adapt itself to the new reality and unprecedented crimes committed. The challenge is to maintain legal principles while providing an appropriate response to the atrocities that occurred, and to ensure that perpetrators are brought to justice. The events of October 7 require a new and adapted legal approach that will enable effectively dealing with war crimes and crimes against humanity. Only this way can justice be ensured for the victims and prevent such horrific acts from recurring in the future.

In a special interview with YNET, Adv. Gez responded sharply to attempts to distort her words: "I am shocked. The fact that there were no complaints stemmed from two reasons – the Hamas terrorists who raped the Israeli young women murdered them, even during the rape. Due to the trauma, women who were raped by members of the terrorist organization and Gaza residents who infiltrated Israel have not mustered the courage to file complaints".

Gez added to YNET: "Regarding sexual offenses committed in captivity against hostages who have returned and shared the horrors they experienced, it will be legally simpler to prosecute and prove what was done to their bodies and souls".
